An Act To Provide For A Referendum As to The Creation Of The North Spartanburg Area Fire District In Spartanburg County And

To Provide For Its Creation In The Event Of A Favorable Vote; To Provide For A Board Of Fire Control For The District; To Prescribe

The Powers, Duties And Membership Of The Board; To Provide For Tax Levies; And To Provide Penalties.

Be it enacted by the General Assembly of the State of South Carolina:

 

SECTION 1. Referendum concerning creation of North Spartanburg Area Fire District. - The Spartanburg County Commissioners of

Election Shall conduct a referendum on the second Tuesday in June, 1964, to ascertain the wishes of the qualified electors residing

within the proposed North Spartanburg Area Fire District on the question of whether or not they favor the establishment of a rural

fire district and favor the necessary tax levy. The commissioners of election shall publish the information relating to the referendum

once a week for two consecutive weeks in a newspaper having circulation in the area.

 

SECTION 2. Conduct of election. - The commissioners of election shall have printed a sufficient number of ballots and have them

distributed at the voting places.

The ballots shall read as follows:

" Do you favor establishing and operating a rural fire department in the North Spartanburg Area and the necessary tax levy?

 

In favor of o

 

Opposed to o

 

Those voting in favor of the question shall deposit a ballot with a check or dross mark in the square after the words ‘In favor of’ and

those voting against the question shall deposit a ballot with a check or cross mark in the square after the words ‘Opposed to’."

Only those persons otherwise qualified and owning taxable property within the area shall be entitled to vote. The officials responsible for canvassing

the results of the election shall, within ten days, certify such results to the clerk of court of the county and the Secretary of State.

 

SECTION 3. North Spartanburg Area Fire District created if election favorable. - If a majority of those voting in the election vote in favor of the

creation of the fire district, there is hereby established the North Spartanburg Area Fire District in Spartanburg County encompassed

within the following area: All that area in Spartanburg County as shown of page 560 of Plat Book 47 in the office of the register of mesne conveyances.

 

SECTION 4. Board of fire control established. - After the creation of the North Spartanburg Area Fire District, there is established a

board of fire control for the district to be composed of five members who shall be appointed by the Governor upon the recommendation

of a majority of the Spartanburg County Legislative Delegation. Provided, that of those first appointed one member shall serve for a term of

one year, two members shall serve for terms of four years and two members shall serve for terms of six years or until their successors are

appointed and qualify. The members of the board shall serve without pay and shall file annually a report with the Spartanburg County Board of

Control not later than the first of November of each year, showing all activities and disbursements made by the board during the year.

If at least twenty per cent of the qualified electors residing in the district petition the commissioners of election by the first of September of any

general election year, the commissioners shall call an election to be held at the following general election for the purpose of electing a member

to the board to succeed the member whose term will expire during such year, for a six-year term. Thereafter, members shall be elected in each

succeeding general election for terms of six years.

 

SECTION 5. Duties. - The board shall have the following duties and responsibilities:

(a) To buy such fire fighting equipment as the board deems necessary for the purpose of controlling fires within the money

     allocated or made available to the board for such purposed.

(b) To select the sites or places within the area where the fire fighting equipment shall be kept.

(c) To provide and select the drivers and other volunteer firemen to man such equipment who shall serve without compensation.

(d) To procure and supervise the training of the volunteer firemen selected to insure that the equipment shall be utilized for the

     best interest of the area.

(e) To be responsible for the upkeep, maintenance and repairs of the trucks and other fire fighting equipment and to that end

     shall, as often as is deemed necessary, inspect such equipment.

(f) To promulgate such rules and regulations as it may deem proper and necessary to insure that the equipment is being used

     to the best advantage of the area.

(g) To construct, if necessary, buildings to house the equipment authorized herein.

(h) To borrow not exceeding twenty-five thousand dollars on such terms and for such a period as to the fire control board may seem

     most beneficial for the fire district in anticipation of taxes. The indebtedness shall be evidenced by a note issued by the member

     of the board and the county treasurer. The full faith, credit and taxing power of the North Spartanburg Area Fire District is hereby

     pledged for the payment of the indebtedness.

 

SECTION 6. Tax levy. - The Auditor and Treasurer of Spartanburg County are hereby directed to levy and collect a tax of not more

than four mills, to be determined by the board of fire control, upon all the taxable property of the district for the purpose of defraying

the expenses incurred by the board. All moneys collected from this levy shall be credited to the fire district.

 

SECTION 7. Supervision of equipment. - The fire chief or equivalent official of the truck company to which the equipment is assigned

shall have complete supervision over its use and operation and it shall be his responsibility to insure that the equipment is readily

available for use at all times.

 

SECTION 8.Enforcement of fire laws. - All members of the truck company of the district may direct and control traffic at the scene of

any fire in the area of the county and enforce the laws of this State relating to the following of fire apparatus, the crossing of fire

hose and interfering with firemen in the discharge of their duties in connection with a fire in a like manner as provided for the

enforcement of such laws by peace officers.

 

SECTION 9. - Unlawful acts - penalties. - It is unlawful to interfere with a member of a fire department in the discharge of his duties

in the district or to interfere with any fire apparatus used by the fire department in the district, and any person so offending shall be

subject to a fine of not exceeding one hundred dollars or imprisonment not exceeding thirty days.

SECTION 10. Time effective. - This act shall take effect upon approval by the Governor.

An Act To Amend Act 1005 Of 1964, Relating To The North Spartanburg Area Fire District, So As To Change The Name To

The North Spartanburg Area Fire And Rescue District And To Provide For The Regulation Of The Rescue Squad And Its

Equipment, And To Provide Penalties.

 

Be it enacted by the General Assembly of the State of South Carolina:

 

SECTION 1 North Spartanburg Area Fire and Rescue District created - There is hereby established the North Spartanburg

Area Fire and Rescue District in Spartanburg County encompassed within the following area: All that area in Spartanburg

County as shown of page 560 of Plat Book 47 in the office of the register of mesne conveyances.

 

SECTION 2. Board - appointment of - petition for election. - After the creation of the North Spartanburg Area Fire and Rescue

District, there is established a board of fire and rescue control for the district to be composed of five members who shall be

appointed by the Governor upon the recommendation of a majority of the Spartanburg County Legislative Delegation.

An Act To Amend Act 1005 Of 1964, As Amended Relating To The North Spartanburg Area Fire And Rescue District,

So As To Increase The Borrowing Authority Of The District To Fifty Thousand Dollars.

 

Be it enacted by the General Assemble of the State of South Carolina:

 

SECTION 1. May Borrow money. - Item (h) of Section 3 of Act 1005 of 1964, as last amended by Act 172 of 1969,

is further amended by striking "twenty-five" on line one and inserting "fifty". Item (h) as amended shall read:

(h) To borrow not exceeding fifty thousand dollars on such terms and for such a period as to the fire and rescue

control board may seem most beneficial for the fire and rescue district in anticipation of taxes. The indebtedness

shall be evidenced by a note issued by the members of the board and the county treasurer. The full faith, credit and

taxing power of the North Spartanburg Area Fire and Rescue District is hereby pledged for the payment of the indebtedness."

SECTION 2. Time effective. - This act shall take effect upon approval by the Governor.

AN ACT TO AMEND CHAPTER 11 OF TITLE 6, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SPECIAL

PURPOSE OR PUBLIC SERVICE DISTRICTS GENERALLY, BY ADDING ARTICLE 9, SO AS TO PROVIDE THAT

ANY LAWFULLY AND REGULARLY ORGANIZED FIRE DEPARTMENT, FIRE PROTECTION DISTRICT, OR FIRE

COMPANY REGULARLY CHARGED WITH THE RESPONSIBILITY OF PROVIDING FIRE PROTECTION TO THAT

JURISDICTION HAS CERTAIN EMERGENCY POWERS.

Be It enacted by the General Assemble of the State of South Carolina:

Emergency powers of fire authorities

SECTION 1. Chapter 11 of Title 6 of the 1976 code is amended by adding:

"ARTICLE 9

Section 6-11-1410. For purposes of this article ‘Fire Authority’ means any lawfully and regularly organized fire

department, fire protection district, or fire company regularly charged with the responsibility of providing fire

protection and other emergency services incident thereto.

Section 6-11-1420. Notwithstanding any other provisions of law, authorized representatives of the Fire

Authority having jurisdiction, as may be in charge at the scene of a fire or other emergency involving the

protection of life or property or any part thereof, have the power and authority to direct such operation as

may be necessary to extinguish or control the fire, perform any rescue operation, evacuate hazardous areas,

investigate the existence of suspected or reported fires, gas leaks, or other hazardous conditions or situations,

and of taking any other action necessary in the reasonable performance of their duty. In the exercise of

such power, the Fire Authority having jurisdiction may prohibit any person, vehicle, vessel, or object from

approaching the scene and may remove or cause to be removed or kept away from the scene any person,

vehicle, vessel, or object which may impede or interfere with the operations of the Fire Authority having jurisdiction.

Section 6-11-1430. The Fire Authority having jurisdiction may, within the means of its resources, evacuate or

cause to be evacuated all persons within and adjacent to burning structures, open fires, dangerous gas leaks,

flammable liquid spills, and transportation incidents.

The following are exempt from the provisions of this act: (1) Industrial processing and manufacturing plants

which have a State Labor Department (OSHA) or Department of Health and Environmental Control approved

emergency evacuation plans; (2) Hospitals and similar type health care facilities which conduct surgery or

administer care through the use of life support systems and which have approved emergency evacuation plans

by the authority having jurisdiction; (3) The Forestry Commission in the carrying out of its forest fire protection

duties and responsibilities as provided in Sections 48-23-90, 48-33-30, 48-33-40, and 48-33-70. The fire

Authority having jurisdiction does not have the power and authority to declare a state of emergency and order

and compel an evacuation of the scope and magnitude that would be necessary during an actual or threatened

enemy attack, sabotage, flood, storm, epidemic, earthquake, riot, or other public calamity.

Section 6-11-1440. In the event an evacuation of any local area is ordered or caused to be effected by any Fire

Authority, the authorized representatives of the Fire Authority shall immediately notify all state and local law

enforcement authorities normally having or exercising police jurisdiction over the area involved. The authorized

representatives of the Fire Authority shall notify the state or local Emergency Preparedness Director of the

evacuation, and upon arrival of law enforcement assistance, shall yield control of the evacuated area to the

law enforcement authorities who shall manage the evacuation and area evacuated cooperation with the Fire

Authority, the state and local Emergency Preparedness director, and other state and local agencies having

jurisdiction and authority under the circumstances.

Section 6-11-1450. Any person who obstructs the operation of the Fire Authority in connection with extinguishing

any fire, or other emergency, or disobeys any lawful command of the fire official or officer of the Fire Authority who

may be in charge at such a scene, or any part thereof, or any police officer assisting the fire Authority, is guilty of

a misdemeanor and , upon conviction, may be fined not more than two hundred dollars or imprisoned for not more

than thirty days."

Statement of accounts, receipts, etc. required

 

SECTION 2. Any Board, commission or Authority in this State, established under the provisions of Chapter 11 Title 6

of the 1976 Code as amended, which provides natural gas to residents of this state, within 30 days of the end of

the fiscal year of the Board, Commission or Authority, provide to the State Treasurer a detailed statement of all

accounts, receipts, disbursements and expenditures of funds by the Board. Commission or Authority during the

preceding fiscal year. The statement shall be in such form as prescribed by the State Treasurer, and shall be

made available for inspection and copying to the public.

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.

Transition provisions

SECTION 2. Members of the Board of Fire and Rescue of the North Spartanburg Area Fire and Rescue District

serving on the act’s effective date shall continue to serve until their terms expire. Additional members elected

to the board pursuant to this act and subsequent members elected shall serve terms of four years as provided for in this act.

Additional members elected to the board pursuant to this act and subsequent members elected shall serve terms of four years as provided for in this act."

COUNTY OF SPARTANBURG

A RESOLUTION ORDERING A PUBLIC HEARING TO CONSIDER THE ENLARGEMENT OF THE NORTH SPARTANBURG VOLUNTEER FIRE DISTRICT

WHEREAS, the Commissioners of the North Spartanburg Volunteer Fire District have petitioned the Spartanburg County Council pursuant to Section 6-11-430 South Carolina Code of Laws, 1976, as amended, to enlarge the North Spartanburg Volunteer Fire District, and

WHEREAS, the Petition appears to be in proper form pursuant to applicable law,

NOW, THEREFORE,

BE IT RESOLVED, that the Spartanburg County Council does hereby order a public hearing to be held on the 11th day of November, 1981 at 5:00 o’clock p.m. In Room 301 of the Spartanburg County Courthouse for the purpose of giving full opportunity to proponents and opponents to be heard concerning the proposed action, and make a finding as to whether and to what extent the boundaries of the District shall be enlarged and to determine all other matters required by law. The Spartanburg County Council does hereby direct that the notice of the public hearing be published once a week for three successive weeks in the newspaper of general circulation in this County.

RESOLUTION NO. 358

COUNTY OF SPARTANBURG

A RESOLUTION APPROVING ENLARGEMENT OF THE NORTH SPARTANBURG VOLUNTEER FIRE DEPARTMENT.

WHEREAS, the Commissioners of the North Spartanburg Volunteer Fire Department have petitioned the Spartanburg County Council pursuant to Section 6-11-430 of the Code of Laws of South Carolina, (1976), as amended, to enlarge the boundaries of the North Spartanburg Volunteer Fire Department; and

WHEREAS, by Resolution, the Spartanburg County Council did order a public hearing to be held on November 11, 1981, for the purpose of giving full opportunity to proponents and opponents to be heard concerning the proposed action and further directed that the notice be published in a newspaper of general circulation in this County; and

WHEREAS, thereafter by Resolution, the Spartanburg County Council changed this hearing date to the held on November 25, 1981, at 5:00 p.m. for those purposes previously referenced; and

WHEREAS, thereafter public notice of the meeting was given and November 2, 9, and 16, 1981, by publication in the Spartanburg Herald Journal, Inc., a newspaper of general circulation in this County as appears by the Affidavit of the advertising clerk of said newspaper; and

WHEREAS, on November 25, 1981 at 5:00 o’clock p.m., a public hearing was held and opinions received concerning the requested enlargement; and

WHEREAS, the Spartanburg County Council found on December 16, 1981, that the boundaries of the North Spartanburg Volunteer Fire District should be enlarged pursuant to the terms of the Petition, with certain amendments being made by the County Council;

NOW, THEREFORE, be it resolved, that the Spartanburg County Council does hereby authorize the enlargement of the boundaries of the North Spartanburg Volunteer Fire District. In addition to the present boundaries of the said District, the enlargement area shall consist of the following described property:

BE IT RESOLVED that no bond shall be issued in connection with the enlargement of the boundaries.

BE IT ALSO RESOLVED that there be no changes in the commission of the North Spartanburg Volunteer District as a result of this boundary enlargement.

BE IT ALSO RESOLVED that this Resolution be published once a week for two successive weeks in a newspaper of general circulation within Spartanburg County.

-Beginning in the center of I-85 where North Tyger River crosses said highway, thence running northwest with North Tyger River to Jordan Creed, to S.C. 129, thence running northwesterly with S.C. 129 approximately one and four tenths mile to a County road, thence running north with center of County road, (splitting parcel 4.00 as shown on Block Map Sheet 5-12-00) to Road 134, thence running westerly with Road 134 to S.C. 292, thence running south with S.C. 292 to the North Tyger River, thence running northwesterly with North Tyger River approximately four-tenths of a mile to a County road, thence running northwesterly along center of County road approximately three miles to State road 217, thence running northwesterly

with State road 217 approximately two-tenths of a mile to a County road on right side, thence running along center of said County road crossing Jordan Creek approximately one mile to Inman-Wellford Road, thence running southeasterly with Inman-Wellford Road to the north shore of Lake Cooley, contour 811, thence running east with contour 811 to the northern shore of Lake Cooley, thence running along the shore of Lake Cooley to an abandoned County road, thence running southeasterly along abandoned County road to State Road 218, thence running northeasterly along center of State Road 213 to a point crossing State Road 40, thence crossing State Road 40 and running northeasterly along Southfield Street to existing boundaries of the North Spartanburg Fire District, thence running along North Spartanburg Fire District boundary in a southerly course to a point on the Westview-Fairforest Fire District boundary, thence leaving the existing North Spartanburg Fire District boundary near State Road 41, and running with the Westview-Fairforest Fire District boundary in a southerly direction to the center of I-85, thence running southwesterly along the center of I-85 to the point of beginning.

AREA B - MEADOWBROOK FARMS SECTION

Beginning on the North Spartanburg Fire District and Boiling Springs Fire District boundaries, near Meadowbrook Subdivision approximately three hundred feet north of Road 581, thence running west with the North Spartanburg Fire District boundary line to a County road, thence leaving North Spartanburg Fire District boundary line running north with said County road approximately nine-tenths of a mile to a County road on the right side, thence running northeast with County road to the New Prospect Fire District boundary line, to the point where it ties with the Boiling Springs Fire District boundary line, thence leaving said point and running with the Boiling Springs Fire District boundary line to the point of beginning.
